These Terms & Conditions ("Terms") govern your access to and use of the ChatBizz mobile application and related services ("ChatBizz", the "App", "we", "us"), operated by NAIM KIRANA. By creating an account or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. Who may use ChatBizz
- You must be at least 18 years old, or the age of majority in your jurisdiction, and legally able to enter into a binding contract.
- You are responsible for the activity on your account and for keeping your login credentials secure.
- You agree to provide accurate account and, where applicable, business information and to keep it up to date.
2. What ChatBizz provides
ChatBizz is a communication and local-commerce platform that lets users chat, make voice/video calls, share ephemeral "snaps" and status updates, discover nearby shops, browse and order products from those shops, and request local pickup/delivery services. ChatBizz acts as a technology platform that connects customers, shops/sellers, and delivery partners; it is not the manufacturer or seller of the products listed by third-party shops unless expressly stated.
3. Orders, payments & pricing
- Prices for products and the applicable platform and delivery charges are shown to you before you confirm an order. The total payable is displayed at checkout.
- Payments are processed by our third-party payment partner, Cashfree Payments. By paying, you also agree to the payment partner's terms. We do not store your full card or bank credentials.
- Requesting a paid pickup/service places you under an obligation to pay the stated fee for that request.
- We may change prices, platform charges, and delivery charges from time to time; changes apply to new orders only.
4. Cancellations, refunds & delivery
Cancellation and refund handling is described in our Refund & Cancellation Policy, and delivery terms are described in our Shipping & Delivery Policy. Those policies form part of these Terms.
5. Your responsibilities & acceptable use
You agree not to use ChatBizz to:
- post or transmit content that is unlawful, harmful, harassing, defamatory, obscene, hateful, or that infringes another person's rights;
- impersonate any person or entity, or misrepresent your affiliation;
- send spam, run scams, or engage in fraudulent transactions;
- upload malware or attempt to disrupt, reverse-engineer, or gain unauthorised access to the App or its systems;
- sell prohibited, illegal, counterfeit, or age-restricted goods where you act as a seller.
We may suspend or terminate accounts that violate these Terms or applicable law.
6. Sellers & delivery partners
Shops/sellers are responsible for the accuracy of their listings, the quality and legality of the goods they offer, and applicable taxes. Delivery partners are responsible for carrying out deliveries they accept. ChatBizz provides the platform and payment/settlement facilitation but is not a party to the underlying sale between a customer and a shop.
7. Ephemeral content (snaps & status)
"Snaps" and status updates are designed to be temporary and are deleted from our active systems after they are viewed or after they expire. Recipients may still capture or record content by other means; please share responsibly.
8. Intellectual property
ChatBizz, its logo, and the software are owned by us and protected by applicable laws. You retain ownership of content you create, and you grant us a limited licence to host, transmit, and display that content solely to operate the service.
9. Disclaimers & limitation of liability
The App is provided "as is" without warranties of any kind to the extent permitted by law. To the maximum extent permitted by applicable law, ChatBizz is not liable for indirect, incidental, or consequential damages arising from your use of the App or from transactions between users and third-party shops or delivery partners.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notice in the App. Continued use after changes means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of India, and the courts at the location of our registered place of business shall have jurisdiction, subject to applicable law.
